1. Acceptance of Terms

By downloading, installing, or using the Migraine Weather app (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

These Terms constitute an agreement solely between you and Migraine Weather — not with Apple, Inc. ("Apple"). Apple is not responsible for the app or its content, and has no obligation to provide maintenance or support for the app.

2. License Grant

Subject to your compliance with these Terms, Migraine Weather grants you a limited, non-exclusive, non-transferable, revocable license to download and use the app on any Apple-branded device that you own or control, solely for your personal, non-commercial purposes, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.

The app is licensed to you, not sold. You may not sublicense, rent, lease, sell, redistribute, or transfer your rights in the app. You may not copy (except as expressly permitted by this license), decompile, reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the app or any part thereof.

Migraine Weather provides weather-based migraine risk forecasts designed to help migraine sufferers anticipate and prepare for weather-triggered migraines. Our Service includes:

You do not need to create an account or provide any personal information to use Migraine Weather. The app generates a random device identifier stored securely on your device. Your location is used solely to provide local weather forecasts and is rounded to approximately 7.5 kilometers for privacy.

5. Accuracy of Information

While we strive to provide accurate weather information and migraine risk predictions, Migraine Weather relies on third-party weather data and statistical models. We cannot guarantee the accuracy, completeness, or timeliness of risk predictions.

Important: The Service is not a medical device and should not be used as a substitute for professional medical advice, diagnosis, or treatment. Always consult with a qualified healthcare provider about your migraines and treatment options.

6. Payments and Subscriptions

Migraine Weather starts with a free 24-hour preview. To continue with full access afterward, you can choose:

Free trials require a payment method on file and automatically convert to a paid annual subscription unless cancelled before the trial ends.

All payments are processed through Apple's App Store. These transactions are subject to Apple's terms and conditions. You may cancel your subscription at any time through your Apple ID settings.

7. Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, icons, and software, are owned by Migraine Weather and are protected by United States and international copyright, trademark, and other intellectual property laws.

8. Limitation of Liability

To the maximum extent permitted by law, Migraine Weather shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

9. Indemnification

You agree to defend, indemnify, and hold harmless Migraine Weather, its employees, contractors, and service providers from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney's fees and costs, arising out of or in any way connected with your access to or use of the Service.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right to modify these Terms at any time. If we make changes, we will provide notice by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

12. Maintenance and Support

Migraine Weather is solely responsible for providing any maintenance and support services for the app, whether required under applicable law or as described in these Terms. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the app.

13. Product Claims

Migraine Weather, not Apple, is responsible for addressing any claims by you or any third party relating to the app or your possession and use of the app, including: (i) product liability claims; (ii) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation. Nothing in these Terms limits Migraine Weather's liability to you beyond what is permitted by applicable law.

14. Legal Compliance

You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties. You agree to comply with all applicable third-party terms of agreement when using the app.

15. Third-Party Beneficiary

Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
